We need your a-furr-mative agreement to enter our cat room.
Please read below carefully before signing; you are agreeing to certain restrictions.

By entering our cat room, you agree to the following Release of Liability, Covenant Not to Sue, and Assumption of the Risk and Indemnification:
In consideration of entering THE SAULT'S CATURDAY CAFE, 177 Gore Street, Sault Ste Marie ON Canada

This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength.

In exchange for The Sault's Caturday Cafe allowing the guest named below to enter the premises and café to interact with the cats and/or kittens located on theses premises in accordance with The Sault's Caturday Café’s rules and at the Cat Café’s standard monetary rates, and for other good and valuable consideration the adequacy and receipt of which is acknowledged, Guest and, if Guest is a minor, Guest’s Parent(s) and/or Legal Guardian(s), hereby agrees and acknowledges the following:

1. The undersigned understands, appreciates, and acknowledges that Guest’s presence in the Premises, as well as Guest’s interaction with the cats and/or kittens located in the Premises, involves an inherent risk of injury and illness for Guest including but not limited to injuries and illnesses such as scratches, bites, cuts and abrasions, contusions, allergic reactions and zoonotic diseases such as bacterial, parasitic, fungal, protozoal, and viral infections. Guest is aware and fully understands the inherent dangers involved in being in the presence of and/or interacting with cats and/or kittens, including the risk of death and/or personal injury or damage to the Guest, other persons, Guest’s property, and/or the property of others while the Guest is located on or in the Premises, in addition to the inherent risk of illness associated with bringing food and/or beverage into the Lounge for consumption. The undersigned further understands, appreciates and acknowledges that these dangers and risks may also impair Guest’s ability to earn a living, engage in other business, social, and recreational activities, and to generally enjoy life. I assume and accept all risk for my participation in these activities, including, but not limited to, personal injury, death, and property damage.

2. WAIVER OF RIGHTS AND RELEASE OF LIABILITY, The undersigned hereby releases, waives, and discharges The Sault's Caturday Café, its members, managers, employees, agents, and partners, to the fullest extent permitted by law, from any and all liability, claims, demands, actions, or causes of action of any sort on account of damage to personal property, loss of companionship, or personal injury, illness, or death which may result from Guest’s presence on or in the Premises, Guest’s interactions with the cats and/or kittens located on or in the Premises, or Guest’s decision to bring food and/or beverages into the Lounge for consumption. This release includes claims based on the negligence of The Sault's Caturday Café Inc., its members, managers, employees, agents, and partners, but expressly does not include claims based on their recklessness or intentional misconduct or gross negligence.

3. The undersigned agrees to abide by all rules and regulations that The Sault's Caturday Café may impose regarding the cats and/or kittens and agrees to undertake all activities in a responsible manner. If the undersigned is unwilling or unable to follow any rules, The Sault's Caturday Café reserves the right to terminate the continuation of any such activities and ask Guest to leave the Premises without advanced notice or return of any admissions paid to enter the Lounge.

4. I acknowledge that The Sault's Caturday Café staff will not monitor or assist with my interaction with the cats, but instead will remain available to generally monitor the activities and the activities of other participants. Staff will be available to generally assist or encourage interaction. The Café makes no guarantees about any level of monitoring or control of the cats. I acknowledge that I will comply with all instructions and rules, and that failure to do so will result in prohibition from further participation. I further acknowledge that I will not be given a refund for my admission if I violate the instructions and/or rules.

5. The parties agree that the provisions of this agreement are severable, and that the invalidity or un enforceability of any one or more of the provisions or clauses of this agreement shall not affect the validity or enforce-ability of the other provisions or clauses of this agreement. This agreement is made pursuant to and shall be governed by the laws of the Province of Ontario (without regard to the laws that might be applicable under the principles of conflicts of law, and without regard to the jurisdiction in which any action or special proceedings may be instituted), as to all matters, including but not limited to matters of jurisdiction, validity, property rights, construction, effect and performance.
6. BY EXECUTING THIS RELEASE, I acknowledge that I have read this release, understand the contents hereof, have been advised and had the opportunity to seek independent counsel of my choice and certify that I have freely and voluntarily executed this release. I acknowledge that, but for the execution of this release and agreeing to be bound by the terms hereof, The Sault's Caturday Café would not authorize me to participate in any activities at The Sault's Caturday Café.

7. I authorize The Sault's Caturday Café to administer certain first aid for injuries I may incur while participating in an activity (such as bandaids and antibiotic cream for scratches ect). I further authorize The Sault's Caturday Café to arrange for my ambulance transportation to a hospital at my or a parent’s/guardian’s expense in the event of your incapacitation as a result of injury, at my own expense. In the event that I should require extra medical care or medications, I agree to be financially responsible for any costs incurred as a result of such treatment. The Sault's Caturday Café make no guarantee or promise to administer first aid.

I am over the age of eighteen (18) and of sound mind and body, and acknowledge that I have read and understood the above waiver and, having determined to proceed of my own volition without coercion or intimidation, intend to be bound by the terms thereof.

PARENT / GUARDIAN WAIVER FOR MINORS
In the event that the participant is under the age of consent (18 years of age), then this release must be acknowledged by a parent or guardian, as follows:

I hereby certify that I am the parent or guardian of the any accompanying Minors and do hereby give my consent without reservation to the foregoing on behalf of this individual.
